Q At the beginning of the chapter, a distinction is made between disparate treatment discrimination and disparate impact discimination. Can you explain the difference giving examples?
Disparate treatment discrimination implies that there has been a different treatment of an employee in the same circumstances. This means that when all the employees (except the discriminated employee) had been treated equally in a specific circumstance, the discriminated employee had been treated in a completely different manner. One example of disparate treatment discrimination could be when there is a female employee being treated in such a way that she is never expected to do overtime or earn overtime pay.
